In Situ Climbing Unit 7 Terms and Conditions / Rules of Membership

1. Your times of use

Monday - Friday: 06.30 - 22.00

Saturday: 08.00 - 22.00

Sunday: 08.00 - 22.00

These times are subject to variation for operational reasons

If there is snow on the ground in Dunkeld, the road to the gym won't be cleared until approximately 08.00 - we should still be open but vehicular access (and parking) won't be immediately available.

2. Use of the facilities

1. This is dependent on maintenance of payments of monthly direct debit or within authorised pre-paid periods of membership. If any direct debit payment is not received on the due date for payment, then your membership will (except in exceptional circumstances and at our sole discretion) be automatically suspended until all due payments have been brought up to date.

2. You will be provided with a non-transferable membership number that you will be requested to use when signing into the facility at the start of your activity session. If your number is used by anyone else with your knowledge or consent, then we reserve the right at our sole discretion to suspend and/or cancel your membership.

3. Any of your property stored in lockers or anywhere else in the facility is stored at your own risk. We regret that we cannot accept liability for any loss or damage that may occur to items stored or placed in the facility.

4. On joining, all members and visitors will be offered an induction to instruct you on the use of the equipment. It is recommended that this is undertaken. If you are subsequently unsure of how to use any equipment, please ask a member of staff. A waiver may be signed if you are a confident gym user.

5. It is mandatory to complete a Physical Activity Readiness Questionnaire before using the facilities.

6. You must inform us if you have sustained a personal injury on the premises or have developed a medical condition that may have consequences for training.

7. Suitable gym clothing and clean footwear must be worn at all times.

8. Only footwear identifiable as climbing shoes is permitted on the climbing walls.

9. Equipment must be treated with respect and efforts made to prevent damage through improper use.

10. Machines and equipment must be wiped down after use with the provided cleaning and sanitising products and left clean and dry. All equipment must be replaced to the correct area.

11. You may not use the gym facilities and equipment while under the influence of alcohol, drugs or any medication that may affect your safety.

12. Only our gym trainers and authorised independent practitioners may train members and visitors.

13. You may not use, block, or interfere with fire or emergency access doors or alarms (except in a genuine emergency).

3. Bookable Activities

1. Bookings can be made up to 4 hours in advance.

2. Attendance for your class/event must be registered upon arrival at the shop counter or with the instructor.

3. Cancellation of a booking must be made no later than 4 hours before the booking is due to start. Any cancellations received within 4 hours of the start time will mean you may be charged.

4. If you do not attend a booked class/event you have booked, you will be charged.

5. If you have an injury or illness that may affect your ability to participate, or if you are a beginner, please consult an instructor before the class starts.

6. Entrance to a class may be refused should you arrive after the warm-up has been completed.

7. Classes and instructors may be subject to change.

8. We reserve the right to restrict a participant's ability to pre-book classes if said participant persistently fails to attend booked sessions.

4. General

1. Membership does not guarantee the availability of a parking space. Parking is available on a first come first served basis. Please only use spaces allocated for Unit 7. If in doubt please check with staff.

2. Adverse weather conditions, particularly overnight snowfall, may impact the access via road to the facility (especially first thing in the morning). The road may not be cleared until 08.30, and often is cleared by our neighbours at the sawmill. We appreciate you being considerate to them. We will provide updates via social media. If in doubt please contact us via email, telephone or social media.

3. Members must keep their personal details up to date at all times.

4. Smoking (including e-cigarettes) is not permitted inside the facility or in the immediate vacinity of the building entrances.

5. Observation and compliance of the contents of signs and notices throughout the facility must be undertaken.

6. Failure to adhere to these rules may result in the termination of your membership.

7. In Situ Climbing Limited will not release your personal data to third parties unless you have given your explicit consent or there is a legal requirement to do so.

8. It is common practice for In Situ Climbing Limited to use photographs and video of the facility, and in some cases clients, in operation to assist with marketing. We will endeavour to ask permission on such occasions but if you have any objections, please notify a member of staff.

9. Reasonable instructions and direction by staff and instructors operating in the facility must be followed, particularly relating to health and safety.

10. Please put your litter in one of the bins we provide. Please recycle items that can be recycled.

11. Please be considerate of neighbouring premises and keep noise levels to a minimum when entering and leaving the gym.

Day Passes

1. Day passes are valid for the day of purchase up until closing only.

2. All gym etiquette applies to day pass users.


1. Memberships will run for the period covered by the payment.

2. No refunds will be given for any unused membership periods under any circumstances

Direct Debit Memberships

1. Memberships will commence once you have indicated your acceptance via completion of membership agreement forms and confirmation of payment has been received.

2. If you did not sign up for membership on the facility premises, you will have 14 full days after signup to cancel for any reason. To exercise this right, you must notify In Situ Climbing Limited by post, email or telephone. We will reimburse all joining and membership fee payments received using the same means of payment used for the initial transaction. If you have used our services before requesting cancellation, we will reduce your membership fee refund by a pro rata amount equal to the number of days from sign-up to the date that cancellation was requested.

3. Your membership will start immediately.

4. The direct debit payment amount is due from you to us. You are obligated to make the minimum number of direct debit payments stated with the first payment due on the first direct debit payment date and every month thereafter. You are obligated to make every direct debit payment regardless of attendance, except where cancellation terms are met.

5. If you fail to pay any monies due under this agreement, or if any direct debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay on demand a £25 administration fee.

6. You agree to provide details to any change in your members details provided.

7. If you fail to pay any amount due under this agreement for a period of thirty days or more, we may pass the debt to a third-party company for collection. The reasonable and direct costs incurred in this will be borne by you.

Automatic Renewal

8. Once the minimum number of direct debit payments has been met, we will automatically continue collecting the direct debit payment amount every payment period. Upon collection of fees, your membership will be extended by the relevant term. The renewal direct debit payment will only be amended if we advise you in writing with no less than 30 days' notice.

9. You may prevent the automatic renewal at any time by giving notice to us with no less than 30 days.


1. Long term (3 months+) injury or illness. This agreement may be cancelled in the event of illness, injury or medical condition in which the written opinion of a doctor or other suitably qualified medical practitioner(s) prohibits exercise for 3 months or longer, upon appropriate proof being provided.

2. Redundancy: this agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

3. This agreement may be cancelled if you become pregnant upon appropriate written proof being given.

4. This agreement can be cancelled if we are in breach of contract including if we do not provide facilities, you may reasonably expect.


1. This agreement may be frozen in the event of a temporary illness, injury or medical condition which the written medical opinion of a doctor or suitable qualified medical practitioner prohibits exercise for a period.

Please note any freeze or cancellation will not be affected until appropriate proof is provided and received in writing.


1. You agree to comply with the rules of membership which are displayed in the facility relating to opening hours, conduct and use of the facilities.

2. If we show leniency in result of a terms breach, this does not stop us enforcing the terms of the agreement strictly at a future date.

3. If any part of this agreement is found by any relevant UK court or legal authority to be disallowed or ineffective, the other provisions shall continue to apply.

18. We may terminate this agreement with immediate effect on notice to you if you are found to be in breach of any part of facility rules or any criminal activity. In this event you will not be liable to pay any further direct debit payments, provided such breach is not deemed by us to have occurred primarily in order to qualify you for a refund.
